1. Acceptance of Terms
By accessing or using Kindtree ("the Platform", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms constitute a legally binding agreement between you and Kindtree Inc.
2. Description of Service
Kindtree is an online platform that connects individuals who host gatherings, classes, and experiences ("Creators") with individuals who discover and attend those gatherings ("Seekers"). Kindtree provides tools for Creators to list, manage, and promote their gatherings, and for Seekers to discover and register for them.
Kindtree does not itself provide gatherings, classes or experiences. We are a technology platform only.
3. User Accounts
- You must be at least 18 years old to create an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate and complete information when creating your account.
- You are responsible for all activity that occurs under your account.
- You may not create accounts for others without their permission.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Creator Terms
As a Creator you agree to:
- Provide accurate descriptions of your gatherings including location, date, time, price, and what participants can expect.
- Honour confirmed bookings or provide reasonable notice and full refunds if cancellation is necessary.
- Comply with all applicable laws and regulations in your jurisdiction including any permits or licences required to host your type of gathering.
- Maintain appropriate insurance where required by law or prudent given the nature of your gathering.
- Treat all attendees with respect and in accordance with our Community Guidelines.
- Handle payment disputes with attendees directly and in good faith.
5. Seeker Terms
As a Seeker you agree to:
- Provide accurate information when registering for gatherings.
- Honour your registrations or cancel with reasonable notice in accordance with the Creator's cancellation policy.
- Complete payment directly to the Creator through the payment method they specify.
- Treat Creators and other attendees with respect and in accordance with our Community Guidelines.
- Take responsibility for assessing whether a gathering is appropriate for your needs, health and circumstances.
6. Payments and Fees
Kindtree does not process payments between Creators and Seekers. All payments are made directly between users via third-party payment services (Venmo, Zelle, PayPal, CashApp and others).
Kindtree charges no commission on transactions.
Kindtree is not a party to any payment transaction and accepts no liability for failed, disputed or fraudulent payments.
Users are solely responsible for any taxes arising from payments received through use of the Platform.
Third-party payment services are governed by their own terms of service. Kindtree has no control over and accepts no responsibility for those services.
7. AI Features
Kindtree uses artificial intelligence features including Kindi, our gathering assistant.
AI-generated content is provided as a suggestion only. Creators are responsible for reviewing and approving all AI-generated listing content before publishing.
Kindtree does not warrant the accuracy, completeness or suitability of any AI-generated content.
Conversations with Kindi may be used to improve our AI features in accordance with our Privacy Policy.
8. Prohibited Conduct
You may not use the Platform to:
- Post false, misleading or fraudulent gathering listings.
- Collect payment without intending to host the gathering.
- Discriminate against users on the basis of race, colour, religion, national origin, sex, gender identity, sexual orientation, disability, or any other protected characteristic.
- Harass, threaten or intimidate other users.
- Violate any applicable law or regulation.
- Attempt to circumvent the Platform's security measures.
- Scrape, copy or reproduce Platform content without permission.
- Use the Platform for any illegal purpose.
9. Content and Intellectual Property
You retain ownership of content you post on Kindtree.
By posting content you grant Kindtree a non-exclusive, worldwide, royalty-free licence to use, display and distribute that content in connection with operating the Platform.
Kindtree's name, logo and Platform design are our intellectual property and may not be used without written permission.
10. Privacy
Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. KINDTREE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.
KINDTREE DOES NOT VET, ENDORSE OR GUARANTEE ANY CREATOR, GATHERING OR CONTENT ON THE PLATFORM. YOU USE THE PLATFORM AT YOUR OWN RISK.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KINDTREE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO KINDTREE (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Kindtree and its officers, directors, employees and agents from any claims, damages, losses or expenses (including reasonable legal fees) arising from your use of the Platform, your content, or your violation of these Terms.
14. Termination
We may suspend or terminate your access to the Platform at any time for violation of these Terms or for any other reason at our discretion.
You may delete your account at any time by contacting us at hello@kindtree.com.
Upon termination, your right to use the Platform ceases immediately.
15. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
For users outside the United States, you agree that any dispute will be resolved in the courts of California.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
16. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the new Terms.
